1. Agreement to these Terms
Pixlcart is a product of Zenpixl, offered at pixlcart.com. “You” means the individual or business that registers for or uses the service. If you use Pixlcart on behalf of a shop or company, you confirm that you have authority to bind that business to these Terms.
These Terms, the Privacy Policy, and any plan details shown at checkout or in a written custom-plan quote form the entire agreement, replacing prior discussions about the same subject.
2. The Pixlcart service
Pixlcart is a hosted e-commerce platform for online merchants. Depending on your plan, it may include a customizable storefront and pages, hosting, product and inventory management, order processing, multi-carrier shipping integrations, coupons, customer CRM, analytics, role-based staff access, a free subdomain, optional custom-domain setup, and support.
We may add, change, or remove features where reasonably necessary to operate, secure, or improve the service. We will not materially reduce core store operations without notice, except for legal, security, or third-party dependency reasons.
3. Eligibility and identity verification
You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. You must provide accurate registration information, including business details and valid identification where required for merchant verification.
We may review, approve, delay, or refuse a registration request. We may ask for additional documents if needed to complete verification, reduce fraud, or meet legal duties. Providing false identity information is a material breach of these Terms.
4. Your account
You are responsible for your account credentials, for staff you invite, and for all activity under the account. Keep passwords confidential and use role-based access appropriately. Notify info@zenpixl.com promptly if you suspect unauthorised access.
You must keep shop name, contact details, and domain information up to date so we can deliver service notices and support.
5. Plans, fees, and billing
Merchants select a paid subscription plan to activate and run their store on Pixlcart; products, orders, and customer records are retained under active subscriptions.
Plans are offered on monthly, quarterly, annual, or custom terms. Prices are shown in US Dollars (USD) and include the features listed on the pricing page at the time of purchase. Launch or promotional pricing applies only for the period advertised.
Fees are prepaid for the selected term. Unless mandatory consumer protection laws in your jurisdiction require otherwise, prepaid fees are non-refundable if you stop using the service during the paid term, except where we fail to provide the contracted service.
Hosting, a free subdomain, and custom-domain setup (when you provide a domain) are included as described on the site. We may change future-term prices with notice before renewal. Missed renewal or non-payment may result in suspension.
6. Payment processing
Merchant subscription payments may be made through supported methods such as credit/debit cards, Apple Pay, and PayPal. Those providers process payment under their own terms and privacy policies. Pixlcart is not a financial institution or banking entity.
Store customer checkout payments (such as cards, digital wallets, or payment gateways on your storefront) are processed by your connected payment partners. You are responsible for configuring payment options lawfully, for reconciling settlements with the provider, and for handling customer payment disputes in line with provider rules and applicable regulations.
We record payment status, method type, and transaction references for billing, order management, and accounting. We do not store wallet PINs, OTPs, or full payment secrets.
7. Merchant responsibilities
You operate your own business on Pixlcart. You are responsible for:
- Complying with all applicable local, national, and international laws, including consumer protection, advertising, sales tax/VAT, product safety, and cybersecurity regulations.
- Selling only lawful goods and services, and describing them accurately on your storefront.
- Your relationship with your customers, including orders, refunds, returns, complaints, and after-sales support.
- Publishing your own store privacy notice and obtaining any consent required for the customer data you collect.
- Content you upload (products, images, pages, policies) and any third-party rights in that content.
- SMS, email, or WhatsApp messages you trigger to customers, including any telecom or spam-control rules that apply.
8. Store customer data
Data your store collects from customers (names, emails, phones, addresses, orders) belongs to your business. You act as the data controller for that data under applicable data privacy laws. Zenpixl processes it as a data processor solely to provide Pixlcart on your instructions.
You warrant that you have a lawful basis to collect and process that data and that you will not upload personal data you have no right to use. You must handle customer access, correction, and deletion requests. We will reasonably assist as your service provider.
We may access store customer data only as needed to operate, secure, or support the platform, or as required by law.
9. Acceptable use
You must not use Pixlcart to:
- Sell illegal, counterfeit, or prohibited products, or to commit fraud, money laundering, or other crime.
- Upload malware, scrape the service, probe or disrupt our systems, or attempt unauthorised access.
- Infringe intellectual property, privacy, or publicity rights.
- Send spam or deceptive messages, or impersonate another person or shop.
- Resell, sublicense, or white-label the platform except with our prior written consent.
- Interfere with other merchants’ stores or with courier or payment integrations.
We may investigate suspected abuse and suspend access immediately where needed to protect customers, partners, or the platform.
10. Intellectual property
Zenpixl and its licensors own Pixlcart, including software, design, trademarks, and documentation. We grant you a limited, non-exclusive, non-transferable licence to use the service during a paid term, solely to operate your store.
You retain rights in your shop name, product content, images, and custom pages. You grant us a licence to host, display, back up, and transmit that content as needed to provide the service.
Feedback you give us may be used to improve Pixlcart without obligation to you.
11. Hosting, availability, and third parties
Hosting and platform updates are included. We aim for high availability (our marketing materials may refer to a 99.9% uptime target) but this is a target, not a warranty, except where a separate written SLA says otherwise.
The service depends on third parties, including couriers and payment providers. We are not liable for delays, outages, lost shipments, or failed payments caused by those partners, force majeure, or events outside our reasonable control. We will take reasonable steps to restore our own systems after an interruption.
12. Account termination
You may stop using Pixlcart and request account closure by contacting info@zenpixl.com. Unless we agree otherwise, prepaid service continues until the end of the current paid term; unused time is not refunded except as required by mandatory law or if we cancel for convenience.
We may suspend or terminate an account immediately if you materially breach these Terms, fail identity verification, fail to pay, use the service unlawfully, or if we are required to do so by law or by a payment or courier partner. Where reasonably practicable we will give notice and a chance to fix a remediable breach.
On termination we take the storefront offline and revoke access. You should request a data export before closure. After the export window described below, we delete or anonymise data as set out in the Privacy Policy.
13. Data export on request or termination
You have the right to export your business data. Email info@zenpixl.com or info@zenpixl.com from the registered account email. After we verify the request, we will provide products, inventory, orders, invoices, coupons, and store customer records in CSV or JSON, usually within 30 days.
The same export remains available for 30 days after account termination. Identity documents and security credentials are not included in a standard export.
It is your responsibility to request and download the export in time. After the window we are not obliged to retain a restorable copy except where applicable law requires us to keep specific records.
14. Disclaimers
Except as expressly stated in these Terms or as required by mandatory law, Pixlcart is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, error-free, or that it will produce any particular sales result.
You are responsible for your commercial decisions, pricing, stock, customer service, and compliance. Demo content and marketing statistics are illustrative.
15. Limitation of liability
To the maximum extent permitted by applicable law, Zenpixl is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for loss of data, goodwill, or business opportunity, arising from the service or these Terms.
Our total liability for all claims arising out of Pixlcart or these Terms is limited to the fees you paid to us for the three (3) months immediately before the claim. If you have not yet paid fees, our liability is limited to $100 USD.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for fraud or for death or personal injury caused by negligence where such exclusion is prohibited.
16. Indemnity
You will indemnify and hold Zenpixl harmless from claims, losses, and reasonable legal costs arising from: your store content or products; your customers’ claims against you; your breach of these Terms or of law; or personal data you instruct us to process without a lawful basis.
17. Governing law and disputes
These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with standard commercial contract laws, without regard to conflict of law principles.
The parties will first try to resolve disputes in good faith by contacting info@zenpixl.com or info@zenpixl.com. If unresolved, disputes shall be submitted to confidential binding arbitration or competent courts having jurisdiction, without prejudice to any non-excludable statutory consumer venue rights.
18. Changes to these Terms
We may update these Terms. The effective date on this page will change when we do. For material changes we will notify the account email where reasonably practicable. Continued use after the new Terms take effect constitutes acceptance. If you do not agree, you must stop using the service and may request account closure and a data export.
